You can sue whom ever you like however winning the case against them is going be the hart part. Once they are notified that you filed a suit, they will fix the problem for you out of goodwill and correct their mistakes. They will have everything taken care of before you the actual court date. That way the public will not be able to find out and ruin their reputation:)
